ESA is concerned that the American bill against deepfakes could harm video games

A new piece of American legislation targeting the spread of deepfakes is set for review this week, and the video game industry is watching closely. While the bill does not explicitly mention video games, the Entertainment Software Association (ESA) has raised concerns that the law could have a negative impact on game development and creative expression.

The ESA argues that the proposed language is too broad. Many of the tools used to create realistic animations, character models, and voice performances in modern video games rely on the same underlying technology that powers deepfakes. If the bill restricts the use of synthetic media without clear exemptions for artistic and commercial use, developers could face legal uncertainty when producing cutscenes, motion-captured dialogue, or even procedurally generated content.

The association is not opposing the goal of stopping malicious deepfakes, such as non-consensual imagery or political disinformation. Instead, it is pushing for clearer definitions that protect legitimate creative work. Without those safeguards, the ESA warns that studios might be forced to abandon certain production techniques or face costly litigation.

The bill is expected to move through committee hearings in the coming days. Industry lobbyists are already working to ensure that any final version includes a carve-out for interactive entertainment.
